Class Action Waiver: You and Twubsy, Inc. agree that any proceedings shall be conducted only on an individual basis and not in a class, consolidated, or representative action.

SECTION 20 - LIMITATION OF LIABILITY CAP

To the fullest extent permitted by law, Twubsy, Inc.’s aggregate liability arising out of or related to the Services shall not exceed the greater of (a) CAD $100 or (b) the total amount you paid us for the product or Service giving rise to the claim.

SECTION 21 - FORCE MAJEURE

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, riots, labour shortages, supply-chain disruptions, utility failures, or governmental action.

The Services are delivered through proprietary and third-party technology that may change, be replaced, or become temporarily unavailable without prior notice. We reserve the right to migrate the Services to alternative hosting or technology providers at any time.
